These Terms of Service (“Terms”) govern your access to and use of OnFito and related services, products, websites, mobile apps, APIs, and features (the “Services”) provided by Fito Technology, LLC (“Fito,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms and our Privacy Policy ([link]).

If you do not agree, do not use the Services.

1) Who May Use the Services

You must be at least 14 years old (or the minimum age where you live, if higher) to use the Services.
You must be 18+ to access or use financial or blockchain features (e.g., wallet connections, on-chain tipping, token purchase links, Launchpad participation).
You represent that you are not barred from using the Services under applicable law and are not on any sanctions or restricted-party list.

2) Accounts & Security

You may create an account with email/social login and (optionally) connect a self-custodial wallet (e.g., Fito Wallet).
You are responsible for your credentials and all activity on your account.
Self-custody: You control your wallet keys. Fito does not have access to or recover private keys or seed phrases.
Report suspected unauthorized activity to [support@fitotechnology.com] immediately.

3) User Content & License

You retain ownership of content you post (text, images, video, audio, links, project pages, comments, etc., “User Content”).
You grant Fito a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for formatting), publish, publicly display, distribute, and otherwise use your User Content only to operate, improve, and promote the Services.
This license ends when you delete your content, except for reasonable backup/cached copies for a limited time or where required by law.
You warrant you have the rights to post your content and that it complies with these Terms and applicable law.

4) Community Guidelines & Prohibited Content

To keep OnFito safe and welcoming, you must not post, share, promote, or facilitate:

Hate, harassment, or abuse

Racism, slurs, or content that attacks people based on protected attributes (including sexual orientation or gender identity); targeted harassment, doxxing, or threats of harm.

Sexual content and nudity

No nudity, pornography, explicit or X-rated content; no sexually exploitative or age-inappropriate content.

Illegal activity

Drug dealing or selling, solicitation or distribution of illegal substances, unlawful services, or instructions to commit illegal acts.
Weapons: sale, trade, or solicitation of firearms, explosives, or prohibited weapons.

Fraud and safety risks

Scams, impersonation, deceptive schemes, spam, or manipulation of engagement metrics.
Malware, phishing, or attempts to probe/attack our systems.

Financial promotions

Investment solicitations or token sales that require licensing/registration without compliance; misleading claims about tokens or projects.

Fito may remove content, restrict features, or suspend/terminate accounts at our discretion for violations and may report illegal activity to authorities where required.

5) Web3 Features, Tipping, and Financial Disclaimers

On-chain tipping/payments: When available, you may tip creators in FITO or supported tokens. All blockchain transactions are final, visible on-chain, and subject to network fees. Fito is not a money transmitter and does not custody user funds.
No investment advice: Token cards, price widgets, and third-party links are informational only and not investment, legal, or tax advice.
Risk: Digital assets are volatile and may result in loss of funds. You are solely responsible for your decisions.
Taxes: You are responsible for applicable taxes on your activity.

6) Token Pages, Launches, and Third-Party Links

Token Creator / Fito Boost: User-generated tokens/pages are created by users; Fito does not sponsor, endorse, or guarantee them.
Launchpad: Participation may require KYC/AML and is subject to additional terms and geographic restrictions.
DEX links & price feeds: Provided for convenience; Fito is not responsible for third-party content, accuracy, fees, or security.

7) Verification & Badges

“Verified” or “Audited by Fito” badges indicate certain checks at a point in time, not a guarantee that a project is risk-free. Audits reduce—but do not eliminate—risk.

8) Payments, Fees & Subscriptions

Some features may require fees or subscriptions (e.g., pro pages, promotion tools). Pricing is disclosed before purchase.
Unless required by law or stated otherwise, payments are non-refundable.
We may change pricing or introduce new fees with notice.

9) Intellectual Property

The Services (software, design, logos, trademarks, content) are owned by Fito or its licensors and protected by IP laws.
Do not copy, modify, distribute, reverse engineer, or create derivatives without permission, except as permitted by law.

10) Privacy

Our Privacy Policy explains how we collect, use, and share information. By using the Services, you consent to our data practices.
Do not post personal information you do not wish to make public.

11) Copyright (DMCA) Policy

Send takedown notices to [dmca@fitotechnology.com] with:
(a) your contact info; (b) identification of the work; (c) the allegedly infringing material (URL); (d) statement of good-faith belief; (e) statement under penalty of perjury; (f) your signature.
We may terminate repeat infringers.

12) Beta Features & Service Changes

We may release features labeled beta/experimental that may change or be discontinued.
We may modify, suspend, or discontinue parts of the Services with or without notice, as allowed by law.

13) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
FITO DOES NOT CONTROL BLOCKCHAINS OR THIRD-PARTY SERVICES AND IS NOT RESPONSIBLE FOR NETWORK FAILURES, FORKS, ATTACKS, OR LOSS OF KEYS.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR BUSINESS INTERRUPTION.
OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO FITO IN THE PRECEDING 12 MONTHS, OR (B) US $100.

15) Indemnification

You agree to indemnify, defend, and hold harmless Fito and its affiliates from claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising out of or related to your: (a) use of the Services; (b) User Content; (c) violation of these Terms or law; or (d) infringement of rights.

16) Termination

You may stop using the Services at any time.
We may suspend or terminate your access (including content removal) for any reason, including violations or risks to users, us, or third parties.
Sections that by nature should survive (IP, disclaimers, liability limits, indemnity, dispute resolution) will survive termination.

17) Dispute Resolution; Arbitration; Class Action Waiver (Optional)

Arbitration: Disputes will be resolved by binding arbitration administered by [Arbitration Provider] under its rules.
Governing Law & Venue: These Terms are governed by [State/Country] law. The seat of arbitration is [City, State/Country].
